Terms & Conditons of Trade
Supply of Goods & Services
This document details the standard terms and conditions governing all domestic and commercial contracts executed by MS Plumbing & Heating via our platform localboilerinstaller.co.uk. Please read these provisions carefully prior to accepting any quote layout.
1. DEFINITIONS
1.1 "Agreement" means these Terms and Conditions together with the terms specified in any corresponding
Quotation Document or dynamic online proposal configuration.
1.2 "Customer" means the individual, homeowner, corporate group, or organisation purchasing physical goods,
appliances, conversions, or engineering services from the Company.
1.3 "Company" means MS Plumbing & Heating, operating across online frameworks including
localboilerinstaller.co.uk.
1.4 "Quotation Document" means the comprehensive digital specification layout, scope summary, multi-tier
pricing block, or breakdown form issued dynamically or manually to the Customer.
1.5 "Instant Quotation" means any fixed calculation or structural guide price sup
2. GENERAL SCOPE
2.1 These standard provisions strictly govern every single pipeline agreement, repair visit, system conversion, or
component installation carried out by the Company.
2.2 Before starting any engineering work, the Company will submit an online Quote Layout or Instant Quotation
establishing the clear installation plan and total cost. The Customer must notify the Company immediately if they
spot discrepancies or disagree with items in the proposal.
2.3 The Company will apply reasonable professional effort to complete boiler conversions and heating
installations within suggested windows. However, target time frames are estimates, and time shall not be of the
essence in the execution of onsite works.
3. PRICING & VALIDITY
3.1 The total balances due for equipment supply, structural adjustments, and installation labor are explicitly
outlined within the chosen package tier on the proposal layout.
3.2 All issued dynamic configurations, multi-tier pricing bundles, and custom survey summaries remain fully valid
for a maximum window of 90 calendar days from the date of initial generation.
3.3 The Company strictly reserves the right to adapt pricing targets to match documented marketplace variations
in raw component costs, appliance manufacturing increments, or specialized technical labor rates.
4. ADDITIONAL VARIATIONS & OVERTIME
4.1 Any additional jobs, pipework alterations, or radiator replacements added during the live installation on the Customer's instruction will be calculated and invoiced at prevailing standard rates, unless a fixed flat variation
addendum is agreed beforehand.
4.2 All primary tier installations are scoped based on engineering work taking place during standard daytime
operational shifts. No extra fees will be added if engineers choose to stay later than planned to complete a day's
scope, unless structural variations require separate scheduling.
5. PAYMENT SCHEDULES & MILESTONES
5.1 Standard installation balances must be paid directly to the attending engineer or via the platform payment
gateway immediately upon successful completion of the job and production of the final balance invoice.
5.2 If a system conversion is operational and providing full heating/hot water but awaits an aesthetic trim item
(such as a delaye manufacturer outer casing panel), the standalone value of that accessory item may be
temporarily withheld by the Customer until fitted, leaving the remaining core invoice payable.
5.3 For extensive structural works or whole-house system installations, a 50% deposit balance is required at the
time of order scheduling. Failure to meet the agreed milestones allows the Company to immediately pause onsite
works or terminate the active contract.
5.4 If balances remain unpaid past the 30th calendar day following invoice generation, the Company reserves
the right to apply a 20% flat penalty surcharge to the master account and forward the debt to external collection
agencies, which may affect credit profiles. A daily penalty charge of £5 will also apply to overdue balances.
6. MATERIALS & SYSTEM DAMAGE RISKS
6.1 Ownership of un-fixed equipment, brand new boilers, smart controls, and plumbing accessories does not
pass to the Customer until the corresponding invoice is paid in full.
6.2 All on-site materials, whether unboxed or securely fixed to structural walls, sit at the absolute risk of the
Customer. If components are stolen, damaged by other trades, or compromised via property accidents, the
Customer remains fully liable for the master cost.
7. EQUIPMENT GUARANTEES & WARRANTIES
7.1 The Company guarantees all manual installation workmanship for a period of 12 months following physical
completion. Defective adjustments or alignment errors brought to the Company's attention inside this window will be
rectified free of charge.
CRITICAL WARRANTY COMPLIANCE: Extended boiler warranties are provided directly by the respective equipment manufacturers (e.g., Worcester Bosch, Vaillant, Ideal). To keep these multi-year manufacturer warranties active, the system MUST receive an annual safety service executed by an accredited, Gas Safe registered engineer. Annual servicing is chargeable at prevailing standard rates.
7.2 Components or appliances supplied directly by the Customer are completely excluded from the Company's structural workmanship guarantee framework. Standard servicing on existing, legacy domestic appliances is covered exclusively by a 28-day calibration check guarantee.
8. ONSITE PREPARATIONS & STRUCTURAL IMPACTS
8.1 Unless explicitly budgeted as a separate structural billing item within the online breakdown, Quote configurations do not include the costs of permanent decorative making-good, plaster skim finishes, painting, or custom flooring restoration.
8.2 While engineering teams exercise maximum professional care to avoid superficial markings, Customers are strongly required to clear, lift, or securely cover carpets, furniture, and valuables within the installation area. The Company accepts no liability for accidental tracking or minor markings in work pathways.
8.3 Cuts, entry holes, or access panels made through structural floorboards or wall partitions to routing pipe arrays will be made safe and filled, but final decorative finishing remains the absolute responsibility of the Customer.
Floorboards will be set down, but finished overlay floor coverings will not be permanently refixed.
8.4 The Company accepts zero liability or cost exposure for systemic faults, pipe blockages, air locks, radiator weaknesses, or low-pressure failure modes within the Customer's pre-existing home plumbing circuit that manifest after a new high-efficiency boiler or automated control valve is integrated.
9. POWER FLUSHING CONDITIONS
9.1 Power flushing operations are executed to strict manufacturer specifications to purge corrosive debris and sludge from central heating circuits. However, due to the chemical and physical nature of the process, the Company cannot guarantee it will fix deep, pre-existing structural issues or system imbalances.
9.2 By clearing away internal sludge and corrosion, the high-velocity clearing process may reveal tiny preexisting pinholes or thin metal points in old copper pipework or degraded steel radiators. Any sudden weeping or water leaks caused by removing this internal sludge are not the fault of the Company, and sub-surface repairs will be treated as an additional chargeable job.
10. SPECIALIZED HAZARDS (ASBESTOS)
10.1 Standard quote targets exclude any hazardous material management or specialized remediation actions. If asbestos insulation or legacy board materials are uncovered during installation, all onsite operations will pause
immediately.
10.2 The Customer will be required to hire an accredited asbestos management firm to safely remove or contain the hazard. Engineering work will only resume once an official clearance certificate is provided. All remediation costs are the sole responsibility of the Customer.
11. LIABILITY & JURISDICTION
11.1 Except for instances of death or personal injury resulting directly from verified corporate negligence, the total master liability of the Company under this agreement is strictly limited to the actual cash price paid by the Customer for the specific job.
11.2 The Company will not be held liable for any loss of business, data issues, commercial opportunity loss, structural disruption, or indirect consequential damage forms whatsoever.
11.3 This master agreement shall be governed, tracked, interpreted, and fully enforced in accordance with the laws of England and Wales, and both parties submit exclusively to the jurisdiction of the English and Welsh courts.
